Under Oregon law, a driver under the influence of alcohol, drugs or a combination of both may face a misdemeanor or felony charge of driving under the influence of intoxicants, or DUII. In other states this drunk driving offense may be called a DUI (driving under the influence) or DWI (driving while intoxicated).
Drivers convicted of a first offense must take a minimum 12-hour, four-session education course completed over four weeks. During that time, they must abstain from the use of drugs and alcohol and must submit to a urine test.
Every convicted DUII driver must complete a screening interview to determine which certified substance abuse treatment program the court will recommend. They must pay for the alcohol or drug treatment program's costs, along with a screening fee. The court bases its recommendation on the number of prior DUII convictions a driver has and will assign the driver to either a DUII Education program or a DUII Rehabilitation program.
DUII Education and Rehabilitation Courses in the State of Oregon
According to the Oregon Health Authority (OHA), the DUII Education program is for drivers convicted of their first DUII offense. Under this program, they must have no prior DUII convictions and do not meet the diagnostic criteria for a substance use disorder (SUD). Drivers must take a minimum 12-hour, four-session education course completed over four weeks. During that time, they must abstain from the use of drugs and alcohol and must submit to a urine test.
The DUII Rehabilitation program is for drivers with previous DUIIs or those who meet the diagnostic criteria of a SUD. Drivers referred to DUII Rehabilitation must have taken and completed DUII education courses and also taken and completed SUD treatment services according to the diagnostic assessment results. The number of rehabilitation hours that drivers must take varies and depends on the court's recommendation. During that time, they must abstain from the use of drugs and alcohol and must pass a urine test while outside of a controlled environment for at least 90 days before the course completion. The prices for both DUII Education and Rehabilitation programs vary between counties and service providers, but start at about $500.

DUII Treatment Completion Certificate
After completing their DUII services program, drivers will receive a DUII Treatment Completion Certificate (DTCC). This will be given to the driver by their service provider, which must be state-approved like those listed below from the Substance Use Disorders Services Directory. If they have trouble obtaining one, they can request one from the Oregon Health Authority if they include:
- A completed DTCC request form.
- Proof of referral by the Alcohol and Other Drug Screening Specialists (ADSS).
- DUII program proof of completion.
- Information release form to the DMV.
- Information release form to the ADSS.
- Information release form to the DUII services provider.
If a driver is a resident of another state, the OHA can issue a certificate if that driver includes these documents in their request:
- A completed out-of-state DTCC Request Form.
- Proof of residency out of state.
- Proof of referral by the ADSS.
- A copy of a completion certificate from an out-of-state DUII provider or services completed verification form.
- Information release form to the DMV.
- Information release form to the ADSS.
- Information release form to the DUII service provider.
